This website is operated by Boil Em Up (“Company,” “we,” “us,” “our”). By visiting or purchasing from boilemup.shop, you agree to be bound by these Terms of Service (“Terms”).


1. AGREEMENT TO TERMS

By completing a purchase, you confirm that you:

  • Have read and understood all product descriptions

  • Agree to our No Return / No Refund Policy

  • Accept the nature of perishable food products

  • Understand that flavor, spice, texture, and moisture are subjective

This agreement applies at checkout and at the time of payment authorization.


2. PRODUCT DESCRIPTION & CONDITION (DISPUTE-CRITICAL)

All products sold are perishable food items that are:

  • Fully cooked

  • Sealed for shipment

  • Marinated and seasoned

  • Intentionally wet or saucy

  • Soft in texture due to brining and slow cooking

These characteristics are normal, expected, and disclosed.
Products are considered delivered as described when shipped in accordance with the listing.


3. TASTE & PERSONAL PREFERENCE DISCLAIMER

Taste, spice tolerance, seasoning preference, and texture perception vary by individual and do not constitute a product defect.

Claims based on:

  • “Too spicy / not spicy enough”

  • “Too wet / too saucy”

  • “Didn’t like the taste”

  • “Texture not preferred”

are classified as personal preference and are not valid grounds for disputes, refunds, or chargebacks.


4. FINAL SALE / NO RETURNS

Due to health and safety regulations for perishable goods:

  • All sales are final once shipped

  • No returns, exchanges, or refunds are accepted after shipment

  • This policy complies with Shopify Payments and card network rules for food items


5. SHIPPING & DELIVERY

  • Orders ship Monday–Thursday only

  • No weekend or holiday shipping

  • Orders placed after Thursday ship the next business week

Once an order is marked Delivered by the carrier, responsibility transfers to the customer.

Shipping delays caused by:

  • Carrier issues

  • Weather

  • Incorrect addresses

  • Missed deliveries

do not qualify as “item not received” if tracking confirms delivery.


6. DAMAGED SHIPMENTS (LIMITED EXCEPTION)

We will review claims only if:

  • Damage occurred during transit

  • You notify us within 24 hours of delivery

  • You provide clear photo or video evidence

Approved claims may result in a replacement or store credit, at our discretion.
Cash refunds are not guaranteed.


7. CHARGEBACKS & DISPUTES (VERY IMPORTANT)

By purchasing, you agree that:

  • Filing a chargeback for items delivered as described violates these Terms

  • Unauthorized or false disputes will be contested with:

    • Product descriptions

    • Policy acknowledgements

    • Carrier confirmation

    • Customer communication records

Excessive or fraudulent disputes may result in:

  • Account suspension

  • Future order cancellation

  • Permanent purchase restriction


8. ACCURACY OF INFORMATION

We make every effort to ensure accuracy in descriptions, images, and policies. Minor variations in appearance or flavor do not constitute misrepresentation.


9. LIMITATION OF LIABILITY

Boil Em Up is not liable for:

  • Personal reactions to spice or seasoning

  • Allergic reactions due to failure to review ingredients

  • Losses resulting from personal taste dissatisfaction

  • Delays outside our control

Maximum liability is limited to the purchase price of the product.


10. GOVERNING LAW

These Terms are governed by the laws of the United States.


11. CHANGES TO TERMS

We reserve the right to update these Terms at any time. Continued use of the site constitutes acceptance of changes.
